Legal challenges of the green economy 4.0

Group
The research project highlights the need of a synergic action enforcing the virtuous process starting from production and consumption, coming to an “outcome” generically defined waste and, by recycling or reusing, converting it into energy, a new product that can meet the demands and preferences of market segments characterized by greater responsibility and a different propensity towards value proposals deriving from production processes oriented towards economic and environmental sustainability. Therefore, while the global environmental policy is trying to achieve sustainable development for current and future generations - understood as the development ensuring current needs without compromising the ability to meet those of the future -, governments and local authorities, have to develop and promote “clean” technologies through an integrated and appropriate network system. There are different policies and legislative measures selected to achieve the aforesaid goals.

Overview

The research project highlights the need to improve a synergic action encouraging a concrete implementation of a well-identified pathway tracing back to the green economy and corresponding to the virtuous process that, starting from production and consumption, comes to an “outcome” generically defined waste and, furthermore, recycling or reusing converts it into energy or in secondary raw material. If consumption has always been thought of as hierarchically subordinate to production, - since deciding what to produce also included what to consume -, nowadays, , increasingly influences production’s choices, generating an abnormal and growing amount of waste. In a global scenario in which environmental policy is oriented in achieving sustainable development for current and future generations, the common tendency aims to limit the waste of raw materials as much as possible and to reduce pollution and its environmental impact by addressing proper waste management. Therefore, Economy, Law and Environment must be no longer considered on linear correlations, but rather as parts of an unavoidable circular relationship; indeed, the business ecosystem is inserted within a natural ecosystem whose resources and services, it can enjoy respecting the rules of operation and the physical, biological climatic limits to ensure future survival.
