Overview

The Project aims to analyse, under a multidisciplinary legal perspective, the relevant problematic issues arising from the continuous spread of the "cyberspace", with particular reference to the fundamental requirements for the protection of public order and national security arising in this context. In recent years the relevance of the subject of the research has grown in direct proportion to the progress of the path of digitalization of contemporary society, which has deeply - and irremediably - affected the most various sectors of human life. Indeed, the international scenario of the conflict between Ukraine and Russia shows that the issue of cybersecurity has now become a top priority in national and international government agendas. Having regard to the complexity of the issue and the importance of the interests involved, the main scientific objective of the Project is not only to propose an interpretative adaptation of the existing legal categories, but also to develop new institutes and principles of public law, in order to obtain a better regulation and human control of the phenomenon. In this sense, the heterogeneous components of the concept of “public cybersecurity” require the use of a multisectoral research methodology, which will involve academic staff with strong expertise in the areas of constitutional law, administrative law and comparative public law. Specifically, the Project aims to focus scientific activities within the following thematic areas: 1) the cybersecurity function between the organizational dimension and the administrative tools of prevention and repression; 2) the State power in cyberspace and the mechanisms of protection of rights inside the Internet; 3) the regulatory sources of public security in the cyberspace and the problem of digital sovereignty; 4) the public-private interrelationship in the safeguarding of cybersecurity. The results of the survey of the Units and of the whole research group will be published in open source and will be discussed in academic conferences and in seminar activities involving all members of the legal and non-legal academic community and civil society. The main scientific activities will also be incorporated into a Forum or website, in order to ensure the widest possible dissemination of the research results and to promote a better culture of the dangers and safeguards inherent in individual rights in the cyberworld. From this perspective the Project ultimately strives to make institutions and citizens as a whole more aware of the risks associated with the continuous spread of cyberspace, without underestimating, at the same time, the remarkable opportunities offered by the digital revolution within the traditional public-private relationship.
