abstract:
The multiculturalism that characterizes Western societies, the relevance of the “culture of differences”, the values that distinguish extraneous communities to the original one, require us to assess the extent to which different traditions and religions can be recognized, especially if they have a strong negative impact on the fundamental rights of foreign minors. The task of the legal scholars and the judges is to balance and to verify which values, in any specific case, are renounceable or negotiable and which are not. The inclusion in our socio-cultural heritage of values extraneous to our legal culture based on the principle of human dignity in all its forms and respect for multiculturalism cannot lead to the sacrifice of constitutional rights
